1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the website located at gunrack.deals and any related services, features, and content (collectively, the "Site"), operated by Gunrack ("Gunrack," "we," "us," or "our").
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree to these Terms, do not access or use the Site.
We may update these Terms from time to time. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
2. Eligibility and Age Requirement
You must be at least 18 years of age to access or use the Site. By using the Site, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms.
You are solely responsible for ensuring that your access to and use of the Site, and any purchase or transfer of any firearm, ammunition, or related product you pursue with any third party, complies with all applicable federal, state, and local laws, including any minimum age requirements that may be higher than 18 for certain products in your jurisdiction.
3. What the Site Is — and Is Not
The Site is an informational price-comparison and discovery platform. Gunrack aggregates and displays product information, pricing, availability, and related data advertised by third-party retailers and dealers ("Dealers"), and provides tools such as price comparison, deal listings, dealer information, an FFL (Federal Firearms Licensee) locator, product reviews, community features, and general informational content regarding firearms-related regulations.
Gunrack does not sell firearms, ammunition, or any other products. Specifically, and without limitation:
Gunrack is not a retailer, dealer, seller, or Federal Firearms Licensee, and is not a party to any transaction between you and any Dealer or other third party.
Gunrack does not process, broker, facilitate, ship, transfer, or fulfill any sale, purchase, or transfer of any firearm, ammunition, or other product.
Gunrack does not host user-to-user sales or transactions of any kind. The Site does not enable you to buy from, sell to, or transfer any product to any other user.
All purchases, sales, and transfers occur solely between you and the applicable Dealer or third party, on that third party's own website and terms, and are subject to that third party's policies and to all applicable law.
We display information to help you compare and locate products and dealers. We do not participate in, and are not responsible for, any transaction.
4. Third-Party Dealer Information and Pricing
Product listings, prices, discounts, availability, shipping costs, promotional codes, and related information displayed on the Site are provided by, or derived from, third-party Dealers and other sources. This information:
Is provided for general informational and comparison purposes only;
May be inaccurate, incomplete, outdated, or unavailable at the time you view it or attempt a purchase;
May differ from the price or terms actually offered by a Dealer at the point of sale; and
Is not an offer by Gunrack to sell anything, and does not guarantee that any product is available or will be sold or honored at any displayed price.
We do not guarantee the accuracy, completeness, timeliness, or reliability of any Dealer information. Always confirm current pricing, availability, product details, and terms directly with the Dealer before making any purchase decision. Your dealings with any Dealer, including the payment for and delivery of products and any other terms, are solely between you and that Dealer.
5. FFL Locator
The Site provides a tool to help you locate Federal Firearms Licensees ("FFLs") that may be able to receive a firearm transfer. This information is derived from publicly available data (such as data published by the Bureau of Alcohol, Tobacco, Firearms and Explosives) and is provided for informational convenience only.
Gunrack does not verify, endorse, or guarantee any FFL's current licensing status, operating status, business hours, contact information, willingness or ability to receive a transfer, fees, or compliance with applicable law. Distances shown are approximate. You are responsible for independently confirming an FFL's status, terms, and suitability directly with that FFL before relying on any listing. Gunrack is not affiliated with, and is not responsible for the conduct of, any FFL listed.
6. Compliance and Legal Information — NOT LEGAL ADVICE
The Site may present general information regarding firearms-related laws, regulations, restrictions, and compliance ("Compliance Information"). This information is provided for general educational purposes only and does not constitute legal advice.
Firearms laws are complex and vary by federal, state, county, and municipal jurisdiction, and they change frequently.
Compliance Information may be incomplete, inaccurate, out of date, or inapplicable to your specific circumstances.
Gunrack is not a law firm, does not provide legal advice, and no attorney-client relationship is created by your use of the Site.
You are solely responsible for knowing and complying with all laws that apply to you. Do not rely on the Site as a substitute for the advice of a qualified attorney or the applicable governing authorities. You should independently verify all applicable laws and, where appropriate, consult a licensed attorney before purchasing, transferring, possessing, or transporting any firearm, ammunition, or related product. Gunrack disclaims all liability arising from any reliance on Compliance Information.
7. Your Responsibilities and Acceptable Use
You agree that you are solely responsible for compliance with all applicable federal, state, and local laws in connection with your use of the Site and any purchase or transfer you pursue with any third party.
You agree not to:
Use the Site for any unlawful purpose or in violation of any applicable law or regulation;
Use the Site to facilitate, arrange, or attempt any transaction that is unlawful, including any transfer of a firearm or ammunition to a person prohibited by law from possessing it, any "straw purchase," or any transaction that circumvents required background checks, licensing, or transfer requirements;
Provide false, misleading, or inaccurate information, including as to your age or eligibility;
Attempt to gain unauthorized access to the Site, other users' accounts, or our systems;
Interfere with, disrupt, overload, scrape, or reverse-engineer the Site or its underlying systems, or use bots or automated means except as expressly permitted;
Upload or transmit malware or any harmful code;
Infringe the intellectual property or other rights of Gunrack or any third party; or
Use the Site to harass, abuse, threaten, or defraud any person.
We reserve the right to investigate and take appropriate action, including removing content, suspending or terminating accounts, and reporting activity to law enforcement, for any violation of these Terms or applicable law.
8. User Accounts
Some features require you to register an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate your account at any time, with or without notice, for any reason, including suspected violation of these Terms.
9. User-Generated Content
The Site may allow you to submit content, including deals, reviews, ratings, comments, forum posts, and other materials ("User Content").
Responsibility. You are solely responsible for your User Content and represent that you have all necessary rights to submit it and that it does not violate these Terms, any law, or any third-party right.
License. You grant Gunrack a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Site.
No obligation to publish; moderation. We are not obligated to publish or retain any User Content and may edit, remove, or refuse any User Content at our discretion, without notice.
No endorsement. User Content reflects the views of the user who submitted it, not Gunrack. We do not verify and are not responsible for User Content, including reviews or user-submitted deals.
Feedback. Any suggestions or feedback you provide may be used by us without restriction or compensation to you.
10. Dealer Subscriptions and Paid Features
Dealers may purchase subscriptions or other paid features to list or promote their information on the Site ("Dealer Services").
Billing. Fees, billing cycles, and features are described at the point of purchase. By subscribing, you authorize us (and our payment processors) to charge the applicable fees. Subscriptions may renew automatically unless canceled as described at purchase or in your account settings.

Dealer responsibility. Dealers are solely responsible for the accuracy, legality, and currency of the data and content they provide, and for their own compliance with all applicable laws in the operation of their business and any transaction with any user. Gunrack does not verify Dealer data and is not responsible for it.
Suspension/termination. We may suspend, modify, or terminate Dealer Services for violation of these Terms, non-payment, or as otherwise described at purchase.
Payment processing may be handled by third-party processors subject to their own terms; we are not responsible for their acts or omissions.
11. Intellectual Property
The Site and its content (excluding User Content and third-party Dealer data), including text, graphics, logos, design, software, and other materials, are owned by or licensed to Gunrack and are protected by intellectual property laws. Except as expressly permitted, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any part of the Site without our prior written consent. "Gunrack" and "gunrack.deals," and associated logos, are our marks; all other marks are the property of their respective owners.
12. Third-Party Links and Content
The Site contains links to third-party websites and displays third-party content and data. We do not control and are not responsible for third-party websites, content, products, services, or practices. Links and listings do not imply endorsement. Your use of any third-party website is at your own risk and subject to that third party's terms and policies.
13. Disclaimer of Warranties
THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, Gunrack disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising out of course of dealing or usage of trade.
Without limiting the foregoing, Gunrack does not warrant that: (a) the Site will be uninterrupted, secure, or error-free; (b) any pricing, availability, Dealer information, FFL information, or Compliance Information is accurate, complete, current, or reliable; or (c) any product will be available or sold at any displayed price or terms. You use the Site and rely on any information from it at your own risk.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GUNRACK AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, ANY DEALER OR THIRD-PARTY INFORMATION OR TRANSACTION, ANY FFL INFORMATION, OR ANY COMPLIANCE INFORMATION, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL GUNRACK'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO GUNRACK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Gunrack and its owners, members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms or any applicable law; (d) your dealings or transactions with any Dealer or third party; or (e) your violation of any rights of any third party.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in [Coles county], Illinois, and you consent to personal jurisdiction and venue there.
Informal Resolution. Before filing any claim against Us, You agree to contact Us at info@gunrack.deals to attempt to resolve the dispute informally. You must contact Us in writing within one (1) year of the event giving rise to the dispute. Failure to attempt informal resolution within one (1) year constitutes a breach of this Agreement.
Governing Law. This Agreement and Your use of Our website are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles.
Exclusive Jurisdiction and Venue. You and We agree that the state and federal courts located in Coles County, Illinois shall have exclusive jurisdiction over any dispute arising out of or relating to this Agreement, Your use of the Gun Rack Deals platform, or any transaction or interaction between You and Us. You consent to personal jurisdiction and venue in those courts and waive any objection based on forum non conveniens.
Waiver of Jury Trial. YOU AND WE EACH KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR OUR PLATFORM.
Remedies. In the event of any breach or violation of this Agreement, We shall be entitled to enforce all legal and equitable remedies including, without limitation, actual damages, statutory damages under applicable statutes, disgorgement of profits, treble damages, and reasonable attorneys' fees and costs. These remedies are in addition to any other rights available under law.
Injunctive Relief. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or breach of Section Section 7 (Your Responsibilities and Acceptable Use) of this Agreement.
17. Termination
We may suspend or terminate your access to the Site at any time, with or without cause or notice. Upon termination, the provisions of these Terms that by their nature should survive (including Sections 3–6 and 9–18) will survive.
18. Miscellaneous
Entire Agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Gunrack regarding the Site.
Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
No Waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms without our consent; we may assign them freely.
No Third-Party Beneficiaries. These Terms create no third-party beneficiary rights.
